Welcome to the Baker Botts PTAB Blog.

Under the America Invents Act (AIA), patent challengers now have three new ways to attack a patent’s validity: Inter Partes Review (IPR), Post-Grant Review (PGR), and Covered Business Method Review (CBMR). These AIA trials are appealing for numerous reasons, including the pace at which the proceedings are performed, the technical know-how of the Patent Trial and Appeal Board (PTAB), and the broader claim construction criterion used.

Given the sharp rise of post-issuance proceedings now being handled by the PTAB of the United States Patent and Trademark Office (USPTO), seemingly every day brings the release of decisions and rulings that offer insight on how the PTAB is applying and interpreting the procedural and substantive rules it applies while adjudicating post-grant proceedings.

Staying current can be tough for both patent owners and those challenging the validity of patents, not to mention the legal experts representing those parties. To that end, Baker Botts is pleased to announce the launch of our PTAB blog, a new blog focused on PTAB proceedings.
